Judicial Separation

A decree of judicial separation recognises that a married couple have legally separated.  In order to obtain this, parties must confirm the grounds upon which the decree is sought.  These grounds are the same as those for a divorce petition.  However, the court does not need to be satisfied that the marriage has broken down irretrievably in order to make the decree.

A further difference is that the couple do not need to be married for over a year before seeking a decree of judicial separation.

The parties will continue to be legally married but the court will be able to make decisions about how assets (except pensions) are divided between the couple.
